But the result of these voluntary diversions from the public child welfare system may be a two-tiered system, each of which will serve a different group of vulnerable children. One system will be formalized, funded, supervised, supported, and monitored by the courts. The caregivers in this system, and the system itself, while flawed, will at least offer the majority of children in its care social and economic advantages that they would not receive in their home of origin, and in the best-case scenario, rehabilitative care that will help children recover from the trauma of maltreatment.

Grandparents, aunts, and uncles are sometimes reluctant to adopt the children in their care because the legal proceedings require that the birth parents’ legal and custodial rights to the child are permanently severed. Instead, many relative caregivers prefer legal guardianship as a legally binding option that transfers the child’s custody away from the state and to the guardian.
